General

This agreement governs your use of the poptshirtprinting.com web site (the "Service"), which is operated by Pop T-shirt Printing Company. Additional terms and conditions of use applicable to specific areas of the Service may also be posted in such areas and, together with this agreement, govern your use of those areas. This agreement, together with any such additional term and conditions, are referred to as this "Agreement."  You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.

Pop T-shirt Printing Company reserves the right, in its discretion, to change or modify all or any part of this Agreement at any time, effective immediately upon notice published on the Service. Pop T-shirt Printing Company is not required to provide you with notification that such modifications have been made. Your continued use of the Service constitutes your binding acceptance of these terms and conditions, including any changes or modifications made by Pop T-shirt Printing Company as permitted above. If at any time the terms and conditions of this Agreement are no longer acceptable to you, you should immediately cease all use of the Service.

Rules of Conduct

You agree not to copy, reproduce, transmit, distribute or transfer any content in any other forum, including but not limited to, electronic or print mediums.

PopTshirtPrinting.com is committed to the protection of intellectual property and its appropriate and legal use.  We do not allow others to use your artwork without your permission.

Indemnity

You agree to indemnify, defend and hold Pop T-shirt Printing Company. and its affiliates, and their respective officers, directors, owners, agents, information providers and licensors (collectively, the "Pop T-shirt Printing Company") harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys' fees) incurred by any Pop T-shirt Printing Company in connection with any use or alleged use of the Service by any person, whether or not authorized by you. Pop T-shirt Printing Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Pop T-shirt Printing Company's defense of such claim.

Termination of Services

Pop T-shirt Printing Company reserves the right, in its sole discretion, to restrict, suspend or terminate your access to all or any part of the Service at any time for any reason without prior notice or liability. Pop T-shirt Printing Company may change, suspend or discontinue all or any aspect of the Service at any time, including the availability of any feature, database, or Content without prior notice or liability.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

NEITHER Pop T-shirt Printing Company NOR ANY PROVIDER OF THIRD PARTY CONTENT OR THEIR RESPECTIVE AGENTS WARRANTS THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES Pop T-shirt Printing Company, ANY THIRD PARTY CONTENT PROVIDER, OR THEIR RESPECTIVE AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE OR THE CONTENT. THE SERVICE AND THE CONTENT ARE DISTRIBUTED ON AN "AS IS, AS AVAILABLE" BASIS. NONE OF Pop T-shirt Printing Company , THIRD PARTY CONTENT PROVIDERS AND THEIR RESPECTIVE AGENTS MAKE ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICE, ANY CONTENT OR ANY PRODUCTS OR SERVICES SOLD THROUGH THE SERVICE. NEITHER Pop T-shirt Printing Company NOR ANY THIRD PARTY CONTENT PROVIDER WARRANTS THAT ANY FILES AVAILABLE FOR DOWNLOADING THROUGH THE SERVICE WILL BE FREE OF VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES. YOU EXPRESSLY AGREE THAT THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICE AND THE ACCURACY OR COMPLETENESS OF THE CONTENT IS ASSUMED SOLELY BY YOU.

NEITHER Pop T-shirt Printing Company, ANY THIRD PARTY CONTENT PROVIDER NOR THEIR RESPECTIVE AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF Pop T-shirt Printing Company, THIRD PARTY CONTENT PROVIDERS AND THEIR RESPECTIVE AGENTS SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Agreement as complete integration and amendments

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. If any inconsistency exists between the terms of this agreement and any additional terms and conditions posted on the Service, such terms shall be interpreted as to eliminate any inconsistency, if possible, and otherwise, the additional terms and conditions shall control. The terms of this Agreement shall survive any termination of this Agreement.

Severability

In the event that any one or more of the provisions of this Agreement shall be or become invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining pro-visions of this Agreement shall not be affected thereby.

Privacy Policy

Pop T-shirt Printing Company collects customer information in an effort to improve our customer’s shopping experience and to communicate with our customers about our products, services and promotions. We collect information such as your name, e-mail and postal address and credit card numbers that you provide to us when you place an order or when you save your information with us. The information collected online is used to process and fulfill your order. We also collect e-mail addresses at various locations within the site including when you order from the site so that we can send you any necessary email messages related to your order - such as an order confirmation notice.

Pop T-shirt Printing will not rent or sell your email address for any reason. We do not share credit card information with third parties except for the purpose of processing payment for products you have ordered and as required by law.

Cancellations

Once payment for an order has been approved, cancellation of an order must be made immediately within 24 hours or less.  If apparel goods for job were ordered, a restocking fee may apply.  Orders cancelled after 24 hours are subject to cancellation fees, to be determined by Pop T-shirt Printing Company.

Returns

Pop T-shirt Printing Company does not accept returns.

Printing Errors and Defective Goods

Any printing errors or misprints must be reported within 7 business days from delivery date if order is not satisfactory. If there is a clear printing error or garment damage on our part we will replace order immediately. All other complaints will be investigated and reviewed within 4 business days of first reporting. If printed order matches signed and approved proof, PopTshirtPrinting.com absolves itself from any liability or responsibility for any errors, including, but not limited to, size, placement, color, text and typographical errors.  A proof sheet is an electronic representation of your shirt design.  A signed proof is considered acceptance of total liability for the order.

Order Minimums

The minimum for our screen printing services is 24 pieces for one color and 12 pieces for each additional ink color.  Regardless of the quantity ordered, you will be charged the minimum price.  Example: You order 24 shirts with a one color front and one color back, you will pay for 36 pieces.  This is due to the cost of setting up the job.

Process Printing Requirements

Four/Color Process and Simulated Process printing will be quoted based on the artwork.  There is a 150 piece minimum for process orders.  Color separation charges are billed separately.

Ink Color Changes

Any ink color change will be billed at $15.00 each.  A minimum of 12 pieces is required for each color, otherwise the charge will be $20.00 each.

Printing Dimensions

Our maximum standard imprint area dimensions are 15” wide by 15 ½” high.  Oversize printing is also available with maximum print area of 20” wide by 20” high.   Oversize printing is subject to availability and is quoted on a job per job basis.

Color Separations

Only applies to Process Printing Orders.  Prices may vary.  Based on art work.

PMS Color Matching

The Pantone Matching System was designed specifically for offset printing on paper substrates.  Due to the variables involved in both the substrate and the ink, results cannot be guaranteed when trying to match PMS colors.  A PMS color matching fee may apply in some circumstances.  If you have any questions regarding Pantone, please contact one of our friendly customer service representatives.

Pre-Production Proofs

Pre-Production proofs or spec samples are $45.00 minimum for one color with an additional $35.00 per color plus cost of garment.  Subject to turnaround and rush charges.

Turnaround

Turnaround time is typically 5 business days plus ship transit time on more orders under 9500 pieces.  Process orders are 7-10 business days plus transit.  Turnaround time on orders over 9500 will be quoted.

Spoilage Rate

Please allow for 2% spoilage rate per print location on orders.  We normally run under 1% and will reimburse you for goods spoiled over 2%.

Pricing

We reserve the right to modify any price quotes based on the designs size or any other unique complications.
